If you have a pool in Maryland, you are required by law to have a pool fence. Specific regulations regarding height and other aspects of construction can vary slightly from county to county, but in general, you can use to following (based on the International Residential Code and Consumer Product Safety Commission’s ‘Guidelines for Swimming Pool Barriers’ as a guideline of what to expect for your pool fence.
Swimming Pool Fences in Maryland
Generally, any pool in Maryland that is more than 2 feet deep must have a pool fence around it. In some counties (Montgomery County for example) pools more than 18 inches deep must have a fence around them.
The fence itself must be at least 4 feet tall, “measured from the ground next to the pool, on the side of the fence outside the pool area.” In Montgomery County, the height of the pool fence increases to 5 feet, and in Prince George’s County, 6 feet. Pool fences can go either around the immediate vicinity of the pool, or around the backyard itself. Pool fences also have to be a “permanent enclosure” which generally means they must be anchored into the ground and not easy to climb or penetrate. Regulations regarding the measurements of openings in the fence in between boards or bars ensure that there is not enough room in the fence for a child to poke their head through or otherwise make it through the fence.
